1. Services Rendered; Waste Materials
By signing and paying, the customer agrees to the price and service provided by Waste Services of Wichita LLC (“Waste Services” or “WS”). Waste Services is given the proprietary right to provide equipment, to collect and dispose of waste and recyclables at the customer’s service address provided at time of sign-up. The customer agrees that the Waste Materials collected under these terms and conditions shall not include any prohibited materials. The liability for disposing of prohibited materials shall remain with the customer at all times. Unless it is otherwise provided in these terms and conditions or applicable by law, the liability to the customer’s waste materials remains with the customer until the waste is collected by Waste Services.
The Waste Materials are described as follows: all non-hazardous solid waste, organic waste, and if applicable, recyclables, generated by Customer or at Customer’s service address. Waste Materials shall not include any Excluded Materials. “Excluded Materials” means (a) any waste tires; (b) radioactive, volatile, corrosive, flammable, explosive, biomedical, infectious, bio-hazardous, toxic, regulated medical or hazardous waste, substance or material, as defined by, characterized or listed under applicable federal, state, or local laws or regulations; (c) any materials containing information protected by federal, state or local privacy and security laws or regulations; (d) any materials that, due to their physical or chemical characteristics, require more stringent environmental protection, handling, documentation or other management than normal municipal solid waste; and (e) any other waste or material that is prohibited from being received, managed or disposed of at the disposal facility.
2. Equipment
Any bin(s) or cart(s) provided by Waste Services to customers is considered Waste Services’s property and will be returned to Waste Services upon cancellation of services. While the equipment is in the customer’s possession, the customer will remain liable for any loss or damage to the cart(s) or bin(s) and will be charged $75 per cart or bin, except for normal wear and tear. The customer agrees to keep the cart reasonably clean and free from paint, markings, or permanent alterations; ensure the cart is not intentionally damaged, burned, or abused; and make sure the cart is accessible on service day, not blocked by vehicles, trailers, or other obstructions. On collection day, the customer is expected to provide clear access to the bin(s) from 7am–7pm.
3. Invoices; Payment Terms
In all matters regarding payments and service, the customer’s bin(s) will be delivered within a reasonable time upon the first payment of service, and the 2-year guarantee begins on the day of their first payment.
(a) Autobill.Customers who choose to use autobill will be billed on a monthly basis on the first of each month of their service by Waste Services. The invoices represent Waste Services’s offer to provide such Services for the specified billing period. At the time of signup there will be a prorated cost, and the customer agrees to pay for both the rest of the current month, prorated based on start date, and the entirety of the next month; this is a one-time charge. Following the initial payment, customers will be billed a flat rate on the first of every month. For customers who have agreed to paperless billing, they allow Waste Services to contact them through the contacts they provided.
(b) Payment by check. Customers that pay by check will be billed 30 days in advance of service so that Waste Services can process and accept payment for service (i.e., customer pays June 1st for services that will be provided in the month of July). Checks will be sent to PO Box 198, Maize, KS 67101. At the time of signup there will be a prorated cost; the customer agrees to pay for both the rest of their current month, prorated based on start date, and the entirety of the next month; this is a one-time charge. 4. Charge Increases
Waste Services offers a 2-year rate guarantee. Following the 2 years, Waste Services may increase the customer’s price of their subscription from billing period to billing period. Customers may terminate their subscription at any time. If increases are necessary following the 2-year period, Waste Services may adjust the charges to cover increases to fuel, labor, and disposal, and to cover increased costs due to uncontrollable circumstances or acts of God.
5. Suspension and Termination of Services by Waste Services
Waste Services reserves the right to suspend or cancel services to any customer at its sole discretion. If customer fails to make payment in advance for services, service may be suspended immediately and will not resume until payment is made. Customer will not receive a credit for suspended service due to nonpayment. Waste Services reserves the right to cancel services and collect equipment from customer if payment is not made within 7 days after payment is due.
6. Termination of Services by Customer
Please contact Waste Services to cancel service by calling or texting at (316) 800-0100. Customer equipment will be picked up in a reasonable amount of time. A cart removal fee of $50 will be processed if the service is cancelled within 12 months of the customer’s start date.
7. Miscellaneous
(a) Waste Services shall not be in default for its inability or delay in collecting waste materials from scheduled customers due to events or significant threats of events beyond its reasonable control. (b) These terms and conditions shall be construed in accordance with the laws of Kansas. (c) Customer understands and agrees that in relation to these terms and conditions, it allows for Waste Services to contact the customer regarding this account at the provided phone number(s), including cell phone numbers if provided, or email, and home address.
8. Holiday Schedule and Weather Delay
If your pickup day falls on or after a recognized holiday, your service will be delayed by one day for that week. We observe six major holidays: New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving, and Christmas. Services may be delayed or cancelled due to severe weather or unsafe road conditions. We may adjust the route schedule as safely and reasonably as possible. Customer will not receive a credit for service delays caused by weather.
9. Property Damage
Our trucks and equipment are heavy and may travel on streets, alleys, and private drives. While reasonable care is taken, Waste Services is not responsible for any damage to driveways, curbs, or pavement; damage caused by improper placement of carts by the customer; or damage caused by weather conditions such as mud, ice, or snow. Customers are encouraged to place carts on the street, up against the curb.
10. Recycling Services
All recyclable materials must be clean, dry, empty, loose, and free from contamination. Accepted recyclable materials may include paper products, cardboard, metal containers, glass containers, and certain plastic containers, as specified by the service provider from time to time. Customers are responsible for preparing recyclable materials in accordance with applicable recycling standards and any requirements communicated by the service provider.
Recyclable materials must not contain hazardous waste, prohibited materials, or any items that could damage equipment, create safety hazards, or interfere with recycling operations. Unacceptable materials may include, but are not limited to, contaminated recyclables, hazardous substances, special waste, bulky items, electronics, tires, appliances, and other materials designated by Waste Services. Waste Services reserves the right to reject, process, dispose of, or discontinue acceptance of any recyclable material that does not meet program requirements or for which recycling markets are unavailable. Materials that cannot be reasonably recycled may be disposed of through other lawful means at the customer’s expense.
Customers may be charged for contamination, additional handling, processing, transportation, disposal, or any other costs associated with non-compliant materials. Additional fees may apply for bulky or special items. Recycling service rates and fees may be adjusted periodically to reflect changes in processing costs, disposal costs, recycling market conditions, and other operational factors. Any applicable recycling-related charges or credits shall be determined by the service provider in its reasonable discretion.
